How I Help

Representing a client in deportation proceedings may involve the preparation and presentation of an application for relief from deportation, removal or exclusion, and the collection of related supporting documents. Some cases require an argument made either orally or through a written legal brief.

I will work with you to keep you informed of what is happening during your immigration hearing, so you are aware of the strategies involved and are properly prepared for your day in court.

Together, with my team of experienced legal professionals, we will give your case the best possible chance of a positive resolution.

A Legal Team Working for You

The Grotas Firm is comprised of experienced legal professionals that share a common goal: to do everything in our power to keep families together.

I have personally worked on more than 500 cases and effectively leverage my experience for my clients. Being involved in each case personally allows me to ensure that my team and I are always on the same page.

Deportation can be a scary thing, especially if you or a loved one are facing detention. We work hard to deliver the positive outcome you deserve- that’s what you can expect when you hire The Grotas Firm.

Our First Goal:
Getting You or Your Loved One Out of Jail

There are two parts to any removal proceeding. The first part is getting the client out of jail. The second part is keeping the client in the United States for the rest of his or her life.

In order to achieve the first goal of getting the client out of jail there are numerous steps that can be taken. Each step is complicated, so I will break down the basics here:

  • One step is to ask the government to release my client on bond. Bonds can be paid in cash or the client’s family can put up a house as collateral. At the end of the case, as long as the client makes every court appearance, the money is returned.
  • If the government refuses to release my client, then the next step is to ask the immigration judge to release my client on bond.
  • If the immigration judge refuses to release my client, then the next step is to ask a federal court judge to ensure that my client receives a full and fair opportunity for release.

My team and I will take whatever steps needed in order for my client to be released from jail as soon as possible, including taking the case to federal court if necessary.

Our Second Goal: Obtaining Permanent Residence in the United States for life

In many cases, in order to achieve this goal, extensive preparation is required. We work closely together to ensure we have prepared the best case based on your history, personal, and professional circumstances.

Can the Government Prove their Case?

It is important to investigate whether the government can prove their case.

For example, when the government was unable to meet their burden for one of my clients, I filed a motion that resulted in the termination of my client’s case. As a result, the client was allowed to remain in the U.S. for the rest of his life.

Filing for Deportation Relief

This process is rarely cut and dry, so I will keep you in the loop as your case progress and new developments take place. There are several ways that you may achieve removal relief- which best applies to you depends on your history and country of birth.

A family member being detained and deported can be devastating. To ensure this doesn’t happen, we extensively prepare for court and seek out legal references/precedents that support our case. When required, I will prepare an oral argument or written legal brief.

Federal Litigation

Many immigration judges and state judges make mistakes. And many attorneys are satisfied with unsatisfactory rulings. Most do not want to upset a judge by challenging his or her decision, nor do they want to spend more time appealing the same case at a federal level. However, it is my strong belief that when a judge passes an unfair verdict that could ultimately devastate or destroy a person’s life, it is my responsibility as his or her attorney to do everything in my legal power to prevent that from happening. Taking a case before a federal judge is a serious and time consuming endeavor, but if successful can result in the reversal of a previous decision made by either an immigration or state judge.

Vacating Guilty Pleas

Vacating Guilty Pleas: Many clients find themselves in deportation proceedings after entering a plea of guilty to a crime on the advice of their criminal attorney. Unfortunately, their attorney never tells them that their guilty plea will result in their deportation. This can lead to disastrous consequences. In this scenario, it is my job to handle damage control and keep my client in this country and out of jail.
